The Province Is Extorting Citizens on Short-Term Rentals
The province created a paywall for BC residents to list on platforms such as Airbnb - but for whose benefit?
The fees under BC’s Short-Term Rental Accommodations Act, Housing Minister Ravi Kahlon says, “raise the level of enforcement” against non-compliant operators and “generate additional revenue for municipalities.” That description is accurate as far as it goes. The registry also funds provincial enforcement, empowers the province to delist your short-term rental from platforms such as Airbnb and VRBO, and exempts the hotel industry that lobbied for the law. It arrived during the largest budget deficits in British Columbia’s history (now forecast at $10.9 billion for 2025-26, up from $9.1 billion the year before). It is a revenue scheme, not a housing policy.
The fees are tiered by whether your guests share your bathroom
$100 if you rent your whole home while you are away, or if guests sleep in a bedroom inside your home and share your kitchen and bathroom (the bed-and-breakfast configuration). $450 if you rent any self-contained suite, even one physically attached to the house you live in. $600 if it is a strata hotel unit. The fee has no relationship to property size, nights rented, local vacancy, or regulatory cost. It is a flat tax indexed to whether your tenant has their own kitchen.
Operators that run multiple commercial short term rentals go through the same pricing model as a family with a single suite hoping to help offset their mortgage.
The penalties are steep
The Compliance and Enforcement Unit can impose administrative monetary penalties of up to $5,000 per day for individuals and $10,000 per day for corporations. Municipal tickets reach $3,000 per day per infraction. Regional district prosecutions reach $50,000. The Unit investigates, prosecutes, and adjudicates. There is no hearing before an independent tribunal. Payment is due within 60 days. There is no presumption of innocence.
The province can also order your listing removed. The Act requires Airbnb, VRBO, and every other platform to validate provincial registration numbers and delist any property the province flags as non-compliant. Platforms that refuse face fines of $10,000 per day. The province does not need to take you to court. It sends a notice to the platform, and the platform complies. Your business is shut down by an administrative email. No judge is involved.
The hotel industry wrote the rules
On October 28, 2023, the BC Hotel Association sent its members an email titled “Advocacy win! BC unveils legislation to shift short-term rentals towards long-term housing,” stating that the legislation “incorporates every recommendation that the BCHA has long championed.” The Association commissioned the David Wachsmuth report cited as evidence of harm. Hotels, motels, hostels, strata guest suites, timeshares, and fishing lodges are all exempt from the principal residence requirement. The lobby that funded the case for restriction was excluded from the effect of restriction.
The factual basis is weak
The Wachsmuth report itself attributes only 19.8% of 2017-2019 rent increases to short-term rentals. Over 80% came from other causes. The same report counted 16,810 housing units converted to dedicated STRs as of June 2023, against roughly 2.1 million dwellings in British Columbia.
The market was already correcting before the registry took effect. CMHC’s 2025 Rental Market Report (all sources are at the bottom of the article) shows Metro Vancouver’s purpose-built rental vacancy rate climbed to 3.7%, the highest in more than 30 years, up from 1.6% the year before. Per the Rentals.ca November 2025 national rent report, BC asking rents fell 5.5% year-over-year (tied with Alberta for the steepest provincial decline in Canada), and Vancouver one-bedroom asking rents fell 6.4%. CMHC attributes the shift to record new rental completions and a federal slowdown in non-permanent resident arrivals. None of it was caused by the registry, which had not yet launched.
The international evidence is consistent
Amsterdam capped STRs at 30 nights in 2019: Airbnb listings fell 54% by 2024, while long-term rents rose 34% against 13% nationally. Barcelona imposed a moratorium in 2014: listings fell 24% from 2018 to 2024, rents rose 37% against 9% nationally. New York City’s Local Law 18 took effect in 2023: listings collapsed from roughly 38,500 to about 5,000 (a 92% drop), citywide vacancy stayed at 1.9%, and rents kept rising. Berlin’s 2016 ban was largely overturned by the city assembly two years later. STR restrictions reduce STR listings. They do not reduce rents.
The Act enables warrantless surveillance
Hosts must submit land title certificates, banking statements, ICBC documents, home insurance certificates, property tax notices, speculation tax letters, and homeowner grant confirmations. Platforms must transmit monthly booking data to the province and to municipal governments. There is no warrant. There is no individualized suspicion. There is no meaningful oversight on how municipal staff use the data.
The Act constitutes a constructive taking
The principal residence requirement restricts thousands of properties to long-term residential use with no compensation paid. The Supreme Court in Annapolis Group v. Halifax (2022) confirmed that pattern (state benefit secured by stripping owners of all reasonable economic use) as a compensable taking at common law. The Act contains no clear statutory language displacing that right.
The actual cause of worsening housing affordability
Zoning prohibits multi-family housing on most residential land. Permit timelines run for years. Purpose-built rental stock declined 9% between 1991 and 2011. Federal immigration policy added 1.5 million people in three years with no corresponding housing pipeline. Glaeser and Gyourko’s research shows zoning and land-use restrictions explain most of the cost in expensive markets. Houston, with no zoning, has affordable housing. Vancouver has a registry.
The province knows all of this. It built the registry anyway.
The registry collects fees during a record deficit. It surrenders private financial data to government. It empowers the province to delete listings without a hearing. It eliminates the livelihoods of small operators while exempting the hotels that lobbied for the law. It will not build a single unit of housing.
If you own a short-term rental in BC, you are not a speculator. You are an additional revenue source.
There is a word for taking a citizen’s property and money under threat of penalty, for purposes other than those publicly stated, while the lobby that benefits writes the rules.
That word is extortion.
